Waiver

01Activities & Assumption of Risk

I fully understand and appreciate that axes, hatchets, and sports and gaming equipment of any kind are potentially dangerous, and that there are inherent dangers, hazards, and risks in participating in the activities offered at Electric Sports Social.

I acknowledge and understand that I will be voluntarily engaging in activities at ESS — including but not limited to Axe Throwing, BigHoops, Duck Bowling, and the Pixel Gaming Floor — which may result in the risk of serious injury, scarring, loss of an important bodily function, permanent disability, or death, and may cause severe social or economic losses due to not only my own actions, inaction, or negligence, but also the actions, inaction, or negligence of others, or conditions of the premises or of any equipment used. I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.

I believe that I am physically, emotionally, and mentally able to participate in the ESS activities I have selected and have no known ailments of a physical or mental nature that would impair my ability to safely participate.

I will immediately remove myself from participation and notify the nearest ESS staff member if at any time I sense or observe any unusual hazard or unsafe condition, or if I feel that I have experienced any deterioration in my physical, emotional, or mental fitness for continued participation.

I assume all the risks and accept full responsibility for any damages, injury, permanent disability, or death arising from my participation in ESS activities.

02Release of Liability & Indemnity

I release from, waive, and discharge all actions, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter have for damages or losses on account of injury — including permanent disability and death — or damage to property, caused or alleged to be caused in whole or in part by the negligence or other acts of Electric Sports Social (ESS), its parent companies, subsidiaries, shareholders, directors, officers, employees, or agents, as a result of my participation in any ESS activity. I hereby agree and covenant to save, hold harmless, indemnify, and defend any claim against ESS, its subsidiaries, and its shareholders, directors, officers, employees, or agents, as a result of my participation in any ESS activity.

I agree that I, my assignees, heirs, guardians, and legal representatives agree not to sue Electric Sports Social, its subsidiaries, shareholders, directors, officers, employees, or agents as a result of any injuries or damages arising from participation in any ESS activity.

03Alcohol Policy

I understand that alcohol consumption is not required by ESS. If I consume alcohol while at ESS, I confirm that I am 21 years of age or older, and I do so of my own free will and agree to drink responsibly. I understand that ESS operates in accordance with applicable Georgia state and local ordinances and laws governing the sale and consumption of alcohol.

I assume the risks associated with alcohol consumption and take full responsibility for my own actions, safety, and welfare. I agree to strictly adhere to the policies of Electric Sports Social and all applicable state and local ordinances and laws while on ESS premises.

I agree to exercise ordinary and reasonable care at all times and not to consume alcohol to the extent that my judgment is impaired. I understand the potential risks associated with alcohol consumption and acknowledge that I do not have, or am not aware of, any medical condition that would prevent me from consuming alcohol or would result in injury or damage as a result of alcohol consumption. I acknowledge and agree that ESS shall not be responsible or liable for any accident, injury, theft, loss, or damage caused by my impaired judgment or negligence.

04Staff Rights & Venue Rules

I agree and understand that ESS staff and/or owners reserve the right to refuse entry, suspend, or cancel any activity at any time and for any reason, including but not limited to safety concerns, signs of intoxication, failure to follow briefing instructions, or disruptive behavior. No refund is guaranteed in the event of removal due to guest conduct.

05Photo & Video Release

I hereby grant permission to the rights of my image, likeness, and sound of my voice as recorded on audio or video without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed — including on social media platforms — and waive the right to inspect or approve the finished product in which my likeness appears. I waive any right to royalties or other compensation arising from or related to the use of my image or recording.

06Minors & Guardian Consent

If I am signing on behalf of a minor, I confirm that I am the parent or legal guardian of the minor(s) named below. I consent to their participation in all selected ESS activities, assume all risks on their behalf, and agree to all terms of this waiver as if they applied directly to me.

For league or recurring play: I agree and understand that this waiver, release, and assumption of risk will remain on file and apply to the current season or agreed participation period unless revoked in writing.

07Communications ConsentOptional

The following communications consent is optional. Participation in ESS activities is not conditional on opting in to any communications below. I agree to receive emails and/or physical mail from Electric Sports Social (ESS) and its affiliates, agents, service providers, and business partners with promotional information on products, services, and events. I agree to allow Electric Sports Social (ESS) and its affiliates, agents, service providers, and business partners to contact me at the phone number listed below using an automatic telephone dialing system, text message, artificial voice, or pre-recorded message for informational, promotional, and marketing purposes. I acknowledge that providing my phone number is not a condition of receiving any goods or services from ESS. I certify that the phone number is accurate and that I own the rights to use it and give consent to call or text that number. Data, text, and roaming charges may apply. Up to 10 texts may be sent per month.

08Health Acknowledgement

I confirm that I am in good physical health and that I am not aware of any medical condition that would make participation in ESS activities unsafe for me or others.
